There probably isn’t a day that goes by when an automaker isn’t being sued for something. Alittle suits are intensely critical, while others peg the needle upon a excitement scale. And whilst Hyundai is flying tall upon the sales charts right now, the Korea n automaker apparently isn’t defence to the trip or two a internal heading infringement court.
At question is the Hyundai Sonata blurb that debuted during a Super Play which linked a company’s new-for-2011 sedan to all things lush. About four seconds into the mark, the brown basketball with gold symbols is shown. Forgive us if we didn’t rughtaway notice that a design of a round is strikingly identical to the colors and symbols of Louis Vuitton, though the world-famous couture company held on right divided. So… are they vehement about a giveaway press during a Super Bowl? Not so most.
A Car Connection reports which Louis Vuitton is suing Hyundai because the French purse maker says the Korean automaker attempted “to benefit commercially from a fame and reputation of the LVM Marks by formulating a false association between Louis Vuitton and the automobiles.” So, what does LV wish for Hyundai’s purported trademark infringement? How about “threetimes damages, punitive indemnification, a halt to a alleged infringement, and alternative remedies.” Sounds a lot more expensive than a Louis Vuitton purse, eh?
We aren’t unequivocally up to speed on the legal ramifications of heading transgression, so you aren’t about to theory as to either or not Hyundai will finish up paying any fines or settlements. We do think it’s the sweet-looking basketball, though, and Louis Vuitton should talk to Hyundai about borrowing that pattern so they can sell a couple of $300$2,300 b-balls. If you don’t remember a commercial in question, strike the burst to see it for yourself.
